Privacy Policy

The short version

Were you just in the booth at a party? This part is for you.

We took your picture. That’s the whole point. The host of the event gets those photos.

If you typed in your number or email, we used it to send you your photos. That’s it. You are not on a marketing list. We didn’t sign you up for anything. We’re not selling your number to anybody.

Your photos live in a gallery the host can see, and may be posted by the host or by us on social media. If you want yours taken down, email privacy@gaberene.com with the event and date. We’ll pull it. No argument, no form to fill out.

Faces. In normal operation the booth just takes pictures. It does not scan or map your face. If an event ever uses a face-matching feature, you’ll see a sign and an on-screen prompt asking permission first, and you can say no and still use the booth.

Kids. If the event is mostly little kids, we run prints only and don’t collect numbers at all.

1. Who we are

1.1 Trendy Booth is a division and assumed name of Gabe Rene LLC, a Texas limited liability company based in Kerrville, Texas. Gabe Rene LLC is the controller of the personal information described here.

1.2 This Policy covers trendybooth.co, any related gallery or portal, and the personal information we collect at live events through our photo booths.

1.3 The general Gabe Rene LLC Privacy Policy at gaberene.com/privacy applies as well. Where the two conflict on a Trendy Booth matter, this Policy controls.

2. Two kinds of people, two sets of data

3. Guest information at an event

3.1 Images and video. The booth captures photographs and, depending on the package, GIFs, boomerangs, or short videos. This is the primary information we collect from Guests. An image of you is personal information about you and we treat it that way.

3.2 Contact information is optional. A Guest may enter a mobile number or email address to receive their photos digitally. This is voluntary. You can use the booth and take a print without giving us anything at all.

3.3 What we do with a number or email you enter.

(a) We send you your photos from that session. (b) We keep a record of the send so we can resend if delivery fails. (c) That is all. We do not add you to any marketing list. We do not sell it. We do not share it with the event host. We do not use it to target ads at you.

3.4 Retention of Guest contact information. We delete Guest mobile numbers and email addresses collected at an event within ninety (90) days after the event, once delivery is complete. We retain only a minimal suppression record where someone has replied STOP, so we do not message them again.

3.5 Survey or data capture features. Some booth software offers optional guest surveys, email list building, or lead capture for the host. We do not enable those features unless the host requests them in writing and appropriate notice is given to guests at the booth. If a feature like that is active at an event, the on-site signage will say so plainly and the on-screen prompt will tell you before you enter anything.

4. Host and site visitor information

4.1 From Hosts we collect the identity, contact, event, transaction, and communication information listed in Section 2, through our inquiry forms, our CRM (Dubsado), email, text, and calls.

4.2 From Site visitors we automatically collect IP address, browser and device type, operating system, referring URL, pages viewed, time on page, and click and scroll behavior, using cookies, pixels, tags, and server logs.

4.3 We use Google Tag Manager, Google Analytics 4, Google Ads, and the Meta Pixel and Conversions API on the Site. See Section 9 for your controls.

5. Biometric information

5.1 Standard operation: no biometrics. In standard operation the booth takes photographs. It does not create, extract, store, or compare a record of face geometry, and it does not identify or match any individual. Automatic face detection used only to set camera focus or exposure, without creating or storing a face template, is not a biometric identifier.

5.2 Texas Business and Commerce Code § 503.001 prohibits capturing a biometric identifier (including a record of face geometry) for a commercial purpose without first informing the individual and obtaining consent. We comply.

5.3 If a face-based feature is in use at an event, including face-match photo finding, automatic face grouping or tagging, facial AI filters, age estimation, or augmented reality virtual props (digital glasses, hats, crowns, animal ears, and similar overlays, which are positioned by detecting the location and spacing of your eyes), then before any capture:

(a) a written notice at the booth will disclose that a biometric identifier will be captured, the specific purpose, and the destruction schedule; (b) an on-screen prompt will require your affirmative consent before capture; and (c) declining is a real option. You may decline and still use the booth normally.

5.4 Our commitments for any biometric identifier we capture. We will not sell, lease, or disclose it except as permitted by § 503.001(c)(1). We will protect it with reasonable care, at least as protective as how we handle other confidential information. We will destroy it within a reasonable time and no later than the first anniversary of the date the purpose for collection expires, which for an event is the conclusion of the event and delivery of the gallery. In practice we destroy face templates within thirty (30) days of the event.

5.5 We apply these protections to every Guest at every event, regardless of state of residence.

6. How we use information

We use personal information to:

(a) capture, process, print, and deliver booth content; (b) send a Guest their photos by text or email when requested; (c) build and host the event gallery for the Host; (d) quote, contract, staff, schedule, invoice, and deliver events; (e) provide support and communicate about a booked event; (f) use selected booth content in our own portfolio and marketing, subject to the limits in our Terms of Service Section 6 and to any opt-out request; (g) operate, secure, and improve the Site; (h) measure and optimize advertising, on the Site only, not against Guest contact data; (i) send marketing to people who separately opted in; and (j) comply with legal obligations and enforce our terms.

7. How we share information

7.1 We do not sell personal information, and we have not in the preceding twelve months.

7.2 We do not share Guest contact information with the event Host. If a Host wants guest contact data, that requires a separate, disclosed, opt-in capture at the booth. See Section 3.5.

7.3 We share information with:

7.4 Targeted advertising. We run Google and Meta advertising for the Site. Under Texas and California law that may count as “targeted advertising” or as “sharing” for cross-context behavioral advertising, even though no money changes hands. You may opt out. See Sections 9 and 10. Guest contact information collected at a booth is never used for advertising.

8. Retention

9. Cookies, tracking, and your controls

9.1 The Site uses strictly necessary, analytics, advertising, and functional cookies and similar technologies. The booth itself does not use advertising cookies or trackers.

9.2 Your controls:

9.3 Global Privacy Control. We honor the GPC browser signal as a valid opt-out of targeted advertising and sharing where applicable law requires.

9.4 We do not currently respond to “Do Not Track” browser signals, as there is no consistent industry standard for them. We do respond to GPC.

10. Your privacy rights

10.1 We extend these rights to everyone who asks, Guest or Host, regardless of where you live:

10.2 The fast path for Guests. Email privacy@gaberene.com with the event name, the date, and roughly when you were in the booth. Say what you want: photos removed, number deleted, both. We will handle it and confirm. You do not need to cite a statute at us.

10.3 Verification. We verify identity proportionally to the request. For a Guest photo removal request, describing the image and the event is generally enough. We will not demand sensitive identification documents for a simple takedown.

10.4 Timing. We respond within forty-five (45) days, extendable once by another forty-five (45) days with notice. For EU and UK requests, one (1) month, extendable by two (2) months for complex requests.

10.5 What we cannot always reach. We can delete our copies and remove content we published. We cannot retrieve a print already handed to a guest, or a copy the Host or another guest already downloaded and shared. We will tell you plainly what we removed and what is beyond our reach.

10.6 Cost. Free once per twelve-month period. We may charge for or decline manifestly unfounded, excessive, or repetitive requests, and will explain why.

11. Appeals

11.1 If we decline your request, you may appeal by emailing privacy@gaberene.com with the subject “Privacy Appeal,” including your original request and why you disagree.

11.2 We respond in writing within sixty (60) days with our reasons.

11.3 If we deny the appeal, you may complain to the Texas Attorney General at texasattorneygeneral.gov/consumer-protection, or to the authority in your own jurisdiction.

12. Children

12.1 The Site is intended for users 18 and older, and we do not knowingly collect personal information online from children under 13.

12.2 At events, minors use the booth. We do not ask age at the booth.

12.3 Where an event is attended primarily by children under 13, the Host must tell us at least seven (7) days in advance, and we operate in print-only mode with digital delivery disabled, so no contact information is collected from anyone.

12.4 A parent or legal guardian may request deletion of a minor’s booth content or contact information at any time by emailing privacy@gaberene.com. We will honor it without requiring a form.

13. Security

13.1 We use reasonable safeguards, including encrypted transmission, access controls and strong authentication on business accounts, password protection available on event galleries, encrypted backups, and limited access on a need-to-know basis.

13.2 Booth hardware is attended during events and secured in transit and storage.

13.3 No system is completely secure and we cannot guarantee absolute security.

13.4 We will notify affected individuals and authorities of a breach as required by law, including Texas Business and Commerce Code § 521.053.

14. International

We are in the United States and process information here. If you are outside the United States, your information is transferred to and processed in the United States. Where we transfer personal data out of the EEA or UK, we rely on Standard Contractual Clauses, the UK Addendum, or an Article 49 derogation.

15. Third-party links

The Site and galleries may link to third-party services. We are not responsible for their privacy practices. Read their policies.

16. Changes

We may update this Policy. We will change the “Last updated” date and give additional notice for material changes.
